How does federal overtime work?

Under the Fair Labor Standards Act, non-exempt employees must be paid at least 1.5 times their regular rate for hours worked over 40 in a workweek. A workweek is any fixed, recurring 168-hour period your employer sets; it doesn’t have to start on Monday.

Federal law doesn’t require overtime for weekends, holidays or hours over 8 in a day.

Do therapists get overtime?

It depends on how you’re classified, not your job title.

  • Hourly and per-diem therapists are often non-exempt and eligible for overtime
  • Salaried therapists may be exempt as learned professionals, but only if the job meets the Department of Labor’s salary and duties tests
  • Some hospitals and residential care facilities use the FLSA’s “8 and 80” system, agreed with employees in advance, which pays overtime for hours over 8 in a day and over 80 in a fixed 14-day period instead of over 40 in a week

Ask HR how you’re classified. If you’re unsure, the Department of Labor’s Wage and Hour Division can help.

What about California and other states?

Some states add their own rules. California, for example, requires overtime at 1.5 times the regular rate for hours over 8 in a workday, and double time for hours over 12 in a workday, along with rules for a seventh consecutive workday. Turn on the California option to apply the daily rules. For other states, check your state labor department.
